Terms of Use

These Terms of Use ("Terms") govern your access to and use of the Winelands Atlas website at winelandsatlas.co.za ("the Site"), operated by Brett Lee ("we", "us", "our"). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

Winelands Atlas is an online directory that connects wine lovers with wine farms across the Western Cape, South Africa. The Site provides farm listings, reviews, maps, route planning, and related information. The Site is free to use for visitors. Wine farms may list their estates through Free or Premium subscription tiers.

As a visitor to Winelands Atlas, you agree to:

• Use the Site for lawful purposes only
• Not attempt to interfere with the Site's operation, security, or performance
• Not scrape, crawl, or extract data from the Site using automated tools without our written permission
• Not submit false, misleading, or defamatory reviews or content
• Not impersonate any person or entity

The Site is provided for informational purposes. While we strive to keep information accurate and up to date, we do not guarantee the accuracy, completeness, or reliability of any listing, review, rating, or other content on the Site.

Farm Owners and Managers:

By submitting a listing to Winelands Atlas, you represent and warrant that:

• You are authorised to act on behalf of the wine farm
• All information provided is accurate, current, and not misleading
• You have the right to use any images, logos, or content submitted for your listing
• You consent to your farm's contact details (phone, email, website, address) being displayed publicly on the Site

We reserve the right to edit, modify, or remove any listing at our discretion, including listings that contain inaccurate information, inappropriate content, or that violate these Terms.

Winelands Atlas offers two listing tiers for wine farms:

Free Listing (R0/month)

• Basic farm profile and description
• Location on interactive map
• Contact details displayed
• Region category listing
• Standard search placement

Premium Listing (R1,499/month)

• All Free features, plus:
• Featured/promoted placement in search results and region pages
• Photo gallery (up to 20 images)
• Events and experiences showcase
• Wine menu with tasting notes
• Direct booking integration
• Analytics and visitor insights

Premium subscriptions are billed monthly with no lock-in contract. You may cancel your Premium subscription at any time, and your listing will revert to the Free tier at the end of the current billing period. Fees are non-refundable for the current billing period.

We reserve the right to change subscription pricing with 30 days' written notice to affected subscribers.

Payments for Premium subscriptions are processed through our third-party payment provider. We do not store credit card or banking details on our servers. All transactions are subject to the payment provider's terms of service. You are responsible for ensuring your payment information is accurate and up to date.

Winelands Atlas displays reviews and ratings aggregated from third-party sources (such as TripAdvisor and Google) as well as user-submitted reviews. We do not verify the accuracy of third-party reviews and are not responsible for their content.

If you submit a review on Winelands Atlas:

• It must be based on a genuine experience at the wine farm
• It must not contain offensive, defamatory, or misleading content
• It must not be submitted in exchange for payment or incentives from the farm
• We reserve the right to remove reviews that violate these guidelines

Wine farm owners may not submit reviews for their own farms or pay for fake reviews. Violation of this policy may result in removal of the farm's listing.

All content on the Winelands Atlas website — including text, design, logos, graphics, icons, and software — is the property of Winelands Atlas or its content suppliers and is protected by South African and international copyright laws.

You may not reproduce, distribute, modify, or create derivative works from any content on the Site without our prior written consent.

Wine farms retain ownership of images, logos, and descriptions they submit for their listings. By submitting content, you grant Winelands Atlas a non-exclusive, royalty-free, worldwide licence to display, reproduce, and distribute that content on the Site and in marketing materials for the purpose of promoting your listing and the Winelands Atlas platform.

The Site is provided on an "as is" and "as available" basis. To the fullest extent permitted by South African law, we disclaim all warranties, express or implied, including but not limited to:

• The accuracy, reliability, or completeness of any listing, review, or information on the Site
• The availability or uninterrupted operation of the Site
• The safety, quality, or legality of any wine farm, product, or service listed on the Site

Winelands Atlas is a directory and information platform. We are not a party to any transaction between visitors and wine farms. Any bookings, purchases, or interactions with wine farms are solely between you and the farm.

To the maximum extent permitted by law, Winelands Atlas, its owner, employees, and agents shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from:

• Your use of or inability to use the Site
• Any reliance on information provided on the Site
• Any interaction, transaction, or dispute with a wine farm listed on the Site
• Unauthorised access to your data or submissions

You agree to indemnify and hold harmless Winelands Atlas and its owner from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Site, your breach of these Terms, or your violation of any law or third-party rights.

We reserve the right to suspend or terminate your access to the Site, or remove any listing, at any time and without notice if we believe you have violated these Terms or engaged in conduct harmful to the Site or other users.

For Premium subscribers, termination for cause (e.g., policy violation) will take effect immediately. No refund will be issued for the remaining billing period.

These Terms are governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes arising from these Terms or your use of the Site shall be subject to the exclusive jurisdiction of the courts of the Western Cape, South Africa.

We may update these Terms from time to time. Changes will be posted on this page with an updated "Last updated" date. For material changes, we will make reasonable efforts to notify affected users. Continued use of the Site after changes constitutes acceptance of the revised Terms.
